3. General Principles
3.1 What data is collected and who provides me with this data
Primarily, I process personal data that you provide to me or that I collect during the operation of my website. Occasionally, I may also receive personal data about you from third parties. This can include the following categories:
- Basic personal data (name, address, date of birth, etc.);
- Contact details (mobile number, email address, etc.);
- Financial data (e.g., account details);
- Online identifiers (e.g., cookie IDs, IP addresses);
- Location and traffic data;
- Audio and visual recordings;
3.2 Under what conditions do I process your data?
I treat your data confidentially and in accordance with the purposes set out in this privacy policy. I ensure processing is transparent and proportionate.
If I am exceptionally unable to adhere to these principles, the processing may still be lawful because a justification exists. As a justification, notably:
- Your consent;
- The performance of a contract or pre-contractual measures;
- My legitimate interests, provided they do not outweigh your interests.
3.3 How can you revoke your consent?
If you have given me consent to process your personal data for specific purposes, I will process your data within the scope of this consent, unless I have another justification.
You have the option to revoke your consent at any time by sending an email to the address mentioned in the imprint. Processing that has already taken place is not affected by this.
3.4 In which cases may I disclose your data to third parties?
a. Principle
I may need to rely on the services of third parties or affiliated companies and commission them with the processing of your data (so-called processors). Categories of recipients are notably:
- Accounting, fiduciary, and audit firms;
- Consulting firms (legal, tax, etc.);
- IT service providers (web hosting, support, cloud services, website design, etc.);
- Payment service providers;
- Providers of tracking, conversion, and advertising services.
I ensure that these third parties and my affiliated companies comply with the requirements of data protection and treat your personal data confidentially.
Occasionally, I am also obligated to disclose your personal data to authorities.
b. Disclosure abroad
In the course of processing orders, your personal data may be transmitted to companies abroad. These companies are obligated to the same extent to data protection as I am. The transmission can occur worldwide.
If the data protection level does not correspond to that of Switzerland, I undertake a prior risk assessment and ensure contractually that the same protection as in Switzerland is guaranteed (e.g., using the new standard contractual clauses of the EU Commission or other, legally prescribed measures). If my risk assessment is negative, I take additional technical measures to protect your data. You can access the standard contractual clauses of the EU Commission via the following link. https://commission.europa.eu/publications/standard-contractual-clauses-controllers-and-processors-eueea_de
3.5 How long do I store your data?
I store personal data only as long as necessary to fulfill the specific purposes for which the data was collected.
Contract data is stored for longer than 12 months, as I am obligated by legal regulations. I am required, in particular, to keep business communication, concluded contracts, and accounting vouchers for up to 10 years. If I no longer need such data for the performance of services, the data is blocked and I use it only for accounting and tax purposes.
3.6 How do I protect your data?
I will securely store your data and take all reasonable measures to protect your data from loss, access, misuse, or alterations.
My contractual partners who have access to your data are obligated to comply with the data protection provisions. In some cases, it will be necessary for me to forward your requests to affiliated companies. Even in these cases, your data will be treated confidentially.
Within my website, I use the SSL procedure (Secure Socket Layer) in combination with the highest level of encryption supported by your browser.
3.7 What rights do you have?
a. Right to information
You can request information about the data I have stored about you at any time. I ask you to send your request for information along with proof of identity to info@karakas.ch.
You also have the right to receive your data in a common file format if I process your data automatically and if:
- You have given your consent for the processing of these data; or
- You have provided data in connection with the conclusion or execution of a contract.
I may restrict or deny the provision of information or data if it conflicts with my legal obligations, legitimate own or public interests, or the interests of a third party.
The processing of your request is subject to the legal processing period of 30 days. However, I may extend this period due to high volume of requests, for legal or technical reasons, or because I need further details from you. You will be informed about the extension of the deadline in a timely manner, at least in text form.
b. Deletion and correction
You have the opportunity at any time to request the deletion or correction of your data. I may reject the request if legal regulations oblige me to retain or maintain the data unchanged, or if a permission fact opposes your request.
Please note that exercising your rights may conflict with contractual arrangements and have corresponding effects on the performance of the contract (e.g., early termination of contract or cost consequences).
c. Legal recourse
If you are affected by the processing of personal data, you have the right to enforce your rights through legal proceedings or to file a report with the competent supervisory authority. The competent supervisory authority in Switzerland is the Federal Data Protection and Information Commissioner: https://www.edoeb.admin.ch
